Information We Collect
Personal Information
We collect information that you knowingly provide to us. Some of this information personally identifies you, such as your name, username, email address, third-party account credentials and other information that you provide to us when you sign up for the Services from which you can be personally identified (“Personal Information“).  If you can choose not to provide us with certain information, you may not be able to register with us or use some or all of the features of the Services.

Usage Data and Activity
Whenever you interact with our Services, we automatically receive and record information on our server logs regarding the actions you take on the Services (“Usage Data“).  For example, each time you use the Services we automatically collect browser information, “cookie” information, mobile device information, information about your operating system and/or mobile platform, your service provider, your IP address, your usage of the Services, and the time and duration of your use of the Services.  This usage information may be associated with your account, but we may anonymize your Usage Data so that you cannot be individually identified.  We use this information to help us understand how people use the Services, and to enhance the Services.

Cookies, Web Beacons and Mobile Use
We use cookies (a small text file placed on your computer or mobile device to identify your computer or mobile device and browser) and Web beacons (a file placed on a website that monitors usage).  We also use mobile analytics software, such as Google Analytics or Apsalar Analytics, to allow us to better understand the functionality of the Services on your mobile device.  This software may record information such as how often you use the Services, the events that occur within the application, aggregated usage information, performance data, and where the application was downloaded from.  We use the information gathered in this manner to improve the experience of the Services, such as pre-populating your username for easier login, and to tell us how and when pages and features on our Services are accessed and used and by how many people.  Most browsers are initially set up to accept cookies.  You can set your browser to refuse all cookies or to indicate when a cookie is being sent.  However, certain features of the Services may not work if you delete or disable the use of cookies.  Google Analytics uses cookies to collect and store anonymous information on usage of websites and/or mobile applications.  Some of our Service Providers may use their own cookies and Web beacons in connection with the services they perform on our behalf, as further explained below.

How We Use Information and When We May Share and Disclose Information Generally
We neither rent nor sell your Personal Information in personally identifiable form to anyone. We will not disclose Personal Information to third parties without your consent.  We may disclose to third parties certain Usage Data regarding the Services.  However, in such cases, your Usage Data is anonymized and aggregated with the Usage Data of others and does not identify you individually.

Information You Make Available to Others
By using the Services, including creation of a profile on Yapert or submission of public queries to “Yaperts,” you may make certain of your Personal Information available to others, such as your name, your username, and your picture.  This information may be accessed by users who use the Services or other third party services that are permitted to access the Services.

Third Party Services and Applications
Through the Services, you may elect to access third-party services and applications, such as Facebook, Twitter, LinkedIn, and other third party services.  When you do so, you may be able to import information from those other services and applications and share Content with those services.  Some of those third-party services may also provide us with information from your accounts with them, which may enable us to enhance and personalize your use of the Services.  You may control what information from those third party services you share with the Services.  If you elect to enable such third-party services or applications access to your Yapert account and Content, the information you share with such third-party services and applications will be subject to their privacy policies and your privacy settings.  We have no control over the policies and practices of third-party services as to privacy or anything else, so if you choose to take part in any transaction or service relating to a third-party service, you should review that third party’s policies.  You can control whether your Yapert activity is sent to third-party services and applications by changing the relevant settings in your Yapert account.  You also may be able to control or block such sharing by changing your privacy settings in such third-party services or applications.

Service Providers
We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you (“Service Providers“).We work with other businesses that we believe to be trustworthy and have privacy practices consistent with ours.  For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, and marketing and promotions.  We only provide our Service Providers with the information necessary for them to perform these services on our behalf.  Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized access, use or disclosure.  Service Providers are prohibited from using Personal Information other than as specified by Yapert.

Advertising
We may work with third-party advertisers, search providers, and ad networks (“Advertisers“).  These companies may access and use information about your use of the Services in order to provide advertisements about goods and services that may be of interest to you.  Advertisements may be shown via the Services or third-party websites, applications and online services.  These companies may place or recognize a unique cookie on your computer or mobile device or use other technologies such as Web beacons.

Other Transfers
We may share Personal Information and Usage Data with businesses controlling, controlled by, or under common control with Yapert.  If Yapert is merged, acquired, or sold, or in the event of a transfer of some or all of our assets or equity, we may disclose or transfer Personal Information and Usage Data in connection with such transaction.  You will have the opportunity to opt out of any such transfer if, in our discretion, the new entity plans to handle your information in a way that differs materially from this Privacy Policy.

Compliance with Laws and Law Enforcement
Yapert reserves the right to access, read, preserve, and disclose any information that we reasonably believe is necessary or appropriate to respond to legal requests (including court orders and subpoenas), to protect the safety, property or rights of Yapert or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

Be Careful When You Share Information with Others
Please be aware that whenever you share information on a publicly available profile or any other public forum on the Services, others may access that information.  In addition, please remember that when you share information in any other communications with third parties, that information may be passed along or made public by others.  This means that anyone with access to such information can potentially use it for any purpose, including sending unsolicited communications.

Security
We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of Personal Information and other information transmitted to us.  However, no data transmission over the Internet or other network can be guaranteed to be 100% secure.  As a result, while we strive to protect information transmitted on or through the Services, we cannot and do not guarantee the security of any information you transmit on or through the Services, and you do so at your own risk.

Children’s Privacy
We do not knowingly collect Personal Information from children under the age of 13.  If you are under the age of 13, please do not attempt to register for the Services or send any information about yourself to us.  No one under the age of 13 may provide any personal information to us or on the Services.  If we become aware that we have received Personal Information from a child under the age of 13, we will delete such information from our records.

Processing in the United States
Your Personal Information and communications may be transferred to and maintained on servers or databases located outside your state, province, or country.  If you are located outside of the United States, please be advised that we process and store all information in the United States.  The laws in the United States may not be as protective of your privacy as those in your location.  By using our Services, you agree that the applicable laws in the United States will govern the collection, use, transfer, and disclosure of your Personal Information and communications.

From time to time, we may revise these Terms. You may find the most current version at yapert.com/privacy-policy.  If there is any material revision to these Terms we will notify you via email and/or by providing a notification through the Services or otherwise.  If you continue to access or use the Services after any revisions become effective, you are agreeing to be bound by the revised Terms.
